Latest Financial Trial Trend Roundtable Held Successfully at HHP
On December 18th, 2019, a roundtable conference on Latest Trend of Financial Asset Management Trial was held at HHP. HHP Partner Mr. Jingdong Xu, Mr. Jun He, and Senior Associate, Mr. Qian Ma, spoke at the roundtable event, and shared their views on guarantee measures, financial consumption disputes, contract effectiveness and trust business under the background of the newly released Minutes of the National Court Work Conference on Trial of Civil and Commercial Cases (“Minutes”) with guests from financial institutions.
Mr. He, Partner of HHP, starting from the real cases recently handled by HHP and published by the Supreme People’s Court, systematically analyzed the attitude of the Minutes on various types of guarantee and had heated discussion with the guests.
The second topic was presented by Mr. Ma. Mr. Ma deeply analyzed the trial changes of financial consumption disputes, listed the difficulties in the current trial practice, elaborated the influence of the Minutes on the trial practice of financial consumption disputes, and gave practical advice to improve the risk control by financial institutions.
At the end of the roundtable, Mr. Xu expounded the legal issues related to the determination of the effectiveness of the contract and trust business in the current financial trial, and further explained the impact of the Minutes on the trust business, expecially for the risks faced by the financial institutions engaged in passageway business.
